Terms and Conditions for Daily Manna

1. Acceptance of Terms

By downloading, accessing, or using the Daily Manna web application, mobile application, desktop application, or any related services (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to all of these Terms, you may not use the Service. You must be at least 13 years old to use the Service; users between 13 and 17 must have parental or guardian consent.

2. Description of Service

Daily Manna is a Bible study application and service that provides:

• Verse-by-verse biblical commentary from multiple scholarly sources
• AI-generated answers to biblical questions (powered by Anthropic's Claude API)
• Multiple free Bible translations (KJV, WEB, BSB)
• Personal notes and bookmarks synchronized across devices
• Reading plans and study progress tracking
• Friend and social connection features
• Subscription-based access to premium features (monthly and yearly plans)

The Service is available on the web (yourdailymanna.com), iOS, Android, and desktop platforms.

3. User Accounts

To access the Service, you must register for an account. You agree to:

• Provide accurate and complete information during registration
• Keep your account information current and up to date
• Maintain the confidentiality of your login credentials
• Be responsible for all activity that occurs under your account
• Notify us immediately at yourdailymanna.brett@gmail.com if you suspect unauthorized access

4. Subscriptions, Billing & Cancellation

4.1 Subscription Plans

Daily Manna offers paid subscription plans (monthly and yearly) that unlock premium features, including higher monthly limits for AI-generated questions and reading plan creation. Free accounts may access the Service with limited functionality.

• Subscriber Plan: Up to 20 AI questions per month and 3 reading plans per month.
• Free Plan: AI questions and reading plan creation are not available without a subscription.

4.2 Auto-Renewal — IMPORTANT

Subscriptions automatically renew at the end of each billing period (monthly or yearly) at the then-current subscription price unless you cancel before the renewal date. By subscribing, you authorize Daily Manna and our payment processor (Stripe) to charge your payment method on a recurring basis until you cancel.

4.3 Payment Processing

All subscription payments are processed by Stripe, Inc. Your payment information (credit card number, billing details) is collected and stored by Stripe in accordance with PCI-DSS standards. Daily Manna does not store your full credit card number or CVV. By subscribing, you also agree to Stripe's Terms of Service.

4.4 Price Changes

We reserve the right to change subscription prices at any time. We will provide at least 30 days' advance notice of any price increase via email or in-app notification. Your continued use of the Service after the price change takes effect constitutes acceptance of the new price. If you do not agree to the new price, you must cancel your subscription before the renewal date.

4.5 Cancellation

You may cancel your subscription at any time through:

Cancellation takes effect at the end of your current billing period. You will retain access to premium features until the period ends, after which your account reverts to the free tier. Cancellation does not entitle you to a prorated refund for the unused portion of the current period.

4.6 Refunds

All subscription fees are non-refundable except where required by applicable law (e.g., consumer protection laws in your jurisdiction). If you believe you were charged in error, contact us within 30 days of the charge at yourdailymanna.brett@gmail.com and we will review your request.

For purchases made through the Apple App Store or Google Play Store (mobile app), refund requests must be submitted directly to Apple or Google through their respective platforms, as refund authority rests with the app store.

4.7 Free Trials

If we offer a free trial, it will convert automatically to a paid subscription at the end of the trial period unless you cancel before the trial ends. We will notify you before the trial conversion occurs.

5. Third-Party Services & APIs

5.1 AI Content (Anthropic Claude)

The Service uses Anthropic's Claude AI to compile and format answers to your biblical questions. AI-generated content is provided for informational and devotional purposes only and does not constitute theological, legal, or professional advice. AI responses may occasionally contain errors; always verify important theological conclusions with authoritative sources.

5.2 Firebase (Google)

Account authentication and data storage are powered by Google Firebase. Your use of these features is also subject to Google's Firebase Terms of Service.

5.3 App Stores

When using the mobile app downloaded from the Apple App Store or Google Play Store, you also agree to those platforms' terms of service. In the event of a conflict between these Terms and app store terms regarding the download or installation of the app, the app store terms prevail.

6. Bible Translation Licenses

Daily Manna displays Bible translations under the following terms. Scripture content within the Service is for personal study use only and may not be reproduced, redistributed, or sold separately.

• KJV & WEB: Public domain.
• BSB: Berean Standard Bible, dedicated to the public domain by the Berean Bible Translation Committee.

7. Intellectual Property

7.1 Our Content

All Service content created by Daily Manna — including software, interface design, graphics, logos, and compiled study materials — is owned by Daily Manna or our licensors and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

7.2 Your Content

You retain ownership of personal notes, bookmarks, and other content you create. By using the Service, you grant Daily Manna a non-exclusive, worldwide, royalty-free license to store, display, and process your content solely to provide the Service to you. We do not claim ownership of your personal study content.

7.3 Feedback

If you submit feedback, suggestions, or ideas about the Service, you grant us the right to use that feedback without restriction or compensation to you.

8. Prohibited Conduct

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to the Service, other users' accounts, or our systems
• Share your account credentials with others or create accounts on behalf of others without authorization
• Use automated scripts, bots, scrapers, or other automated means to access the Service or extract Bible content in bulk
• Reverse engineer, decompile, or disassemble the application or attempt to extract source code
• Circumvent, disable, or interfere with security features or usage limits of the Service
• Interfere with or disrupt the integrity or performance of the Service or servers
• Use the Service to distribute spam, malware, or harmful content
• Violate any third-party rights, including intellectual property and privacy rights
• Reproduce or redistribute Bible translation content outside the Service in violation of the applicable license terms
• Misrepresent your identity or affiliation with any person or organization

9. Usage Limits

Subscriber accounts are subject to monthly usage limits (currently 20 AI questions and 3 reading plans per month). Usage counters reset at the start of each calendar month. We reserve the right to adjust these limits with reasonable notice. Usage limits are applied per account and may not be transferred or combined across accounts.

10. Account Termination

You may delete your account at any time via the app settings, the web app (yourdailymanna.com/delete-account), or by contacting support. We reserve the right to suspend or terminate your account at our sole discretion for violation of these Terms, abusive behavior, suspected fraud, or other reasons, with or without notice. Upon termination:

• Your right to use the Service ceases immediately.
• Your personal data will be deleted in accordance with our Privacy Policy (billing records may be retained as required by law).
• Any active subscription will not be automatically refunded for the unused period.

Important: Deleting your account does not cancel an active Stripe subscription. Cancel your subscription via the Billing Portal before deleting your account to avoid future charges.

11. Data Storage and Synchronization

Your account data — including notes, bookmarks, reading plans, and usage history — is stored securely in the cloud using Google Firebase. This enables synchronization across your devices. By using the Service, you consent to this cloud storage and synchronization. We implement reasonable security measures but cannot guarantee absolute security against all threats.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF CONTENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES. AI-GENERATED CONTENT IS NOT INFALLIBLE AND SHOULD NOT BE RELIED UPON AS AUTHORITATIVE THEOLOGICAL OR DOCTRINAL GUIDANCE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DAILY MANNA AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOST PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRIOR TO THE CLAIM OR (B) FIFTY U.S. DOLLARS ($50.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITIES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

14. Indemnification

You agree to indemnify, defend, and hold harmless Daily Manna and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; or (d) your violation of any applicable law.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States and the state in which Daily Manna operates, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, except where prohibited by applicable law. You retain the right to seek relief in small claims court for qualifying disputes. YOU WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.

Notwithstanding the above, users located in the European Union may bring disputes before their local courts or the relevant national consumer protection authority.

16. Service Availability and Modifications

We strive to maintain high service availability but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any feature at any time, with or without notice. We will make reasonable efforts to communicate planned downtime in advance. If we discontinue the Service entirely, we will provide at least 30 days' notice and, where feasible, assist with data export. Subscription refunds for discontinued services will be handled on a prorated basis.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining Terms shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Daily Manna regarding the Service and supersede any prior agreements. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

19. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes via email or in-app notification at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and cancel any active subscription.
